These rights are often advanced as legal rights and protected by the rule of law. However, they are distinct from and prior to law, and can be used as standards for formulating or criticizing both local and international law. It is typically thought that the conduct of governments and military forces must comply with these standards. Perhaps of greatest practical consequence for our present purposes is Article 31 of the Revised European Social Charter . One reason for this may be the fact that the nations standing behind this Charter comprise a relatively homogeneous group and can be expected to have comparatively similar social constructions of moral rights to shelter and housing.
